Notice of Dispute

In the event of a dispute, you or Quick Creator must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via email to: support@quickcreator.io. Quick Creator will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address. You and Quick Creator will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or Quick Creator may commence arbitration.

Binding Arbitration

If you and Quick Creator don't resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by binding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. The dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Either party may seek any interim or preliminary injunctive relief from any court of competent jurisdiction, as necessary to protect the party's rights or property pending the completion of arbitration. Any and all legal, accounting, and other costs, fees, and expenses incurred by the prevailing party shall be borne by the non-prevailing party.

Typographical Errors

If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account or other payment account in the amount of the charge.

TridentData's Fair Usage Policy (FUP)

Introduction

1.1. This Fair Usage Policy ("FUP") applies to all users and customers (“Users”) of the services provided by TridentData Inc. (“TridentData” or the “Company”), including but not limited to the unlimited demo views and unlimited viewers access as part of their plans.

1.2. By using TridentData's services, you agree to comply with this FUP. TridentData reserves the right to modify this policy at any time, effective upon posting the modified policy tohttps://quickcreator.io/terms-of-service.

Purpose

2.1. The purpose of this FUP is to ensure the integrity, security, reliability and privacy of TridentData's network and resources and to ensure that TridentData's Users are able to utilize its services in a fair and equitable manner.

Fair Usage

3.1. The services provided by TridentData, including unlimited demo views and unlimited viewers access, are intended for normal and reasonable use.

3.2. Activities that are inconsistent with the use of the services, or that may impair the Company's ability to provide the services in a reasonable manner,may be considered as excessive or abusive use.

3.3. It is the user's responsibility to monitor their data usage. TridentData will make reasonable efforts to inform users when they are close to or have exceeded their monthly data allowance.

Prohibited Uses

4.1. Users shall not use TridentData's services for any illegal, fraudulent or abusive purpose.

4.2. Users are prohibited from sub-licensing, reselling, or otherwise redistributing TridentData's services without the express written permission of TridentData.

4.3. Users shall not employ any mechanism, device, software or routine to interfere or attempt to interfere with the proper working of TridentData's services.

4.4. Compromising the integrity of our systems, including actions such as probing, scanning, or testing system vulnerabilities within any network hosting our services. Exceptions are granted for security assessments explicitly authorized by us.

4.5. Tampering with, reverse-engineering, or hacking our services; evading security or authentication measures; or attempting unauthorized access to services, associated systems, networks, or data.

4.6. Altering, disabling, or jeopardizing the integrity or performance of the services, related systems, networks, or data.

4.7. Decrypting transmissions to or from the servers running the services.

4.8. Overloading or attempting to overwhelm our infrastructure by imposing an unreasonably large load on our systems, consuming exceptional resources (CPUs, memory, disk space, bandwidth, etc.). This includes actions such as:

5.1. TridentData reserves the right to review user accounts for excessive use. In the event that TridentData identifies excessive use, the Company may reach out to the User to discuss more suitable usage levels or plans.

5.2. TridentData reserves the right to monitor usage to ensure compliance with this FUP.

Consequences of Violation

6.1. In the event of a violation of this FUP, TridentData reserves the right to take any action it deems appropriate, including but not limited to issuing warnings, suspending or terminating services, and/or reporting to the appropriate authorities.

Indemnification

7.1. The User agrees to indemnify and hold harmless TridentData and its officers, directors, and employees from and against any claims, demands, liabilities, losses, damages, costs or expenses, including reasonable attorney's fees, resulting from the User's violation of this FUP.

Dispute Resolution

8.1. Any dispute arising from or related to this FUP shall be governed by the laws of the jurisdiction in which TridentData is registered.

8.2. Users agree to resolve any disputes through binding arbitration, unless otherwise agreed upon in writing by both parties.
